Employment Law Gordon Menzies conducts all types of employment tribunal claims including unfair dismissal and discrimination claims with particular experience of disability discrimination. He acts for both Claimant and Respondent with an emphasis on local authority Respondent work. Recent examples of cases include acting in race discrimination claims brought by teaching staff, an unfair dismissal claim following dismissal consequent upon allegations of abuse made against a social care worker in a care home and a sexual harassment claim involving issues of territorial jurisdiction. He is fully conversant with issues that arise in relation to restrictive covenants, pensions and TUPE transfers. In the Employment Appeal Tribunal he has appeared in the reported cases of Edwards v Surrey Police [1999] IRLR 445 (law relating to time limits) and Truelove v Safeway Stores Ltd [2005] ICR 589 (right to time off under s57 ERA 1996). Gordon’s work also includes claims brought in the County Courts for breach of contract claims and has experience of ‘stress at work’ claims. He sits as a Legal Advisor to Police Disciplinary Tribunals. Health and Safety He both prosecutes and defends health and safety offences involving injuries sustained at work, rail accidents and fatalities. He has experience of all stages of the legal process from inquests to subsequent criminal and civil proceedings. He has acted in cases involving accidents in all areas of industry from construction and retail to the provision of care. He has acted on the behalf of a Defendant in a prosecution arising from the collision of an under bridge inspection unit with a train. He has recently acted in a case involving a particularly serious accident arising from the maintenance of a power station. He was led by Peter Harrison QC in a prosecution of a care home and two of its managers for breaches of helath and safety legislation arising from the death of one of the service users. Gordon regularly acts for companies in relation to allegations of breaches of general duties of health and safety under the Health and Safety At Work Act 1974. He has particular experience in manual handling and working at height cases. Trade and Consumer Law Gordon Menzies has acted in cases involving trademarks and counterfeiting, trade descriptions and consumer credit matters. He also has experience of food safety work. He has recently prosecuted a company for fraud in relation to misleading statements made in the course of selling a holiday club to consumers. He has also prosecuted individuals for illegal money lending and misdescriptions connected with vehicle sales. He has substantial experience of Proceeds of Crime Act applications consequent upon criminal convictions. This includes initial applications for restraint orders and extends to enforcement of orders and applications for reconsideration of benefit determinations. This part of his practice is complemented by acting in relation to civil applications for forfeiture of the proceeds of crime. Civil Law A large part of his civil and commercial practice involves claims for personal injury in the workplace, acting for both employees and employers. His personal injury work spans both relatively straightforward injuries to Fatal Accidents Act cases and whilst he acts for both Claimant and Defendants his work is predominantly defence based. His commercial work also includes breach of contract claims, property disputes and trust law. |
