Profile
Noémi Byrd graduated from Oxford University with a BA Honours degree in English Language and Literature. Before completing her legal studies Noémi worked in the non-governmental sector for six years, most recently for an international environmental law NGO and an academic research centre on international courts and tribunals. Awarded a Lord Justice Holt scholarship by Gray's Inn, Noémi was called to the Bar in 2004 and joined Chambers on successful completion of her pupillage in 2005. Planning, environmental and public law Noémi Byrd undertakes a wide range of planning advisory and inquiry work for local authorities and community groups. Her experience includes retail and housing development, change of use, development in the Green belt and open countryside, and appeals on design, conservation and highways safety grounds. She is instructed at every stage of the planning enforcement process, from advice on enforcement options to appearing in the High Court on appeal. She regularly prosecutes breaches of planning control in the Magistrates' Court. Noémi is also experienced in prosecuting and defending Listed Building matters. She was led in the High Court on a case stated appeal involving a point of law of general public importance in this area, having appeared for the authority at first instance (R (East Riding of Yorkshire Council) v Hobson [2008] EWHC Admin 1003). A substantial part of her practice involves advising and appearing for local authorities and defendants in the areas of environmental protection (particularly noise nuisance), education, compulsory purchase, housing, benefit fraud and licensing. She has a particular interest in highways law and is regularly instructed to advise authorities on their powers and duties under the Highways Act, she prosecutes and defends highways cases in the Magistrates' Court. In the area of Public Rights of Way, Noémi Byrd has successfully represented the highway authority at numerous public inquiries into Definitive Map Modification Orders including diversion orders and extinguishment orders made on security grounds. She has experience of promoting diversion and extinguishment orders on public safety grounds, including the successful promotion of a Special Extinguishment Order in relation to a footpath running through school grounds, under s.118 Highways Act 1980. In the Magistrates' Court she prosecutes section 137 Highways Act cases for local authorities. Civil and Commercial Law Noemi has a broad civil practice with an emphasis on landlord and tenant, including business and residential possession proceedings, renewal of leases and claims for breach of covenant and forfeiture. Her practice includes advising on leasehold enfranchisement and also in relation to adverse possession. She appears for claimants and defendants in neighbour disputes relating to boundaries, easements and private nuisance, and is experienced in representing parties during mediation.
