Nicholas Baldock succeeds in Court of Appeal for Claimant and increases proportion of liability against Defendant in serious road traffic accident

Nicholas Baldock has successfully represented the Claimant in a Court of Appeal contributory negligence case, increasing the proportion of liability against Defendant in a serious road traffic accident.

In Starks v Chief Constable of Hertfordshire [2013] EWCA 782, the claimant ‘s car was struck by a police vehicle which drove straight over a mini roundabout which both parties were negotiating. Each had failed to see the other but the Claimant placed reliance on the causative effect of the Defendant ignoring the mini roundabout in breach of the Highway Code.
