Anne Williams represents restaurant in immediate Article 4 Direction

Anne Williams has represented the Le Colombier restaurant in Chelsea regarding an immediate Article 4 Direction made by the Royal Borough of Kensington and Chelsea. The freeholder of the property is applying for the right to convert it into a shop, or to premises for financial or professional services, and then to convert the upper floors to sell as flats, unless an Article 4 direction is made by the Council.

The Direction would prevent the change of use allowed under permitted development rights recently introduced by the Government under the Town and Country Planning (General Permitted Development) (England) Order 2015 to change a restaurant to a shop.

There will now be further consultation on making the Direction permanent. Considerable support was received from the Chelsea Society and many local residents groups for the retention of the restaurant.
