Mukhtiar Singh has made his first appearance in the Court of Appeal on behalf of an applicant seeking permission to appeal.
The appeal stems from a claim alleging breach of contract against a website design company for locking a website following a dispute about payment. This was a multi-million pound claim with losses alleged to be over £3,000 per day. Injunctive relief seeking the unlocking of the website was refused at first instance and a subsequent unless order made in relation to the costs of the application. The appeal centres around the making of the unless order and the dismissal of the application for it to be set aside. A further ground involves the interpretation of the judgment made at the permission stage of first appeal, where permission was in part granted.
