Sexual assault acquittal – Oliver Saxby QC defending

A 54 year old professional man of previous good character was yesterday acquitted of three counts of sexual assault at Gloucester Crown Court following a seven day trial. The Crown’s case comprised evidence from the adult complainant, recent complaint evidence and complex apparently corroborative DNA evidence. A rigorous approach to the Crown’s disclosure obligations ensured the defence were provided with unused material of relevance to the complainant’s credibility and reliability; and the instruction of a DNA expert, Jo Millington, meant that an assertion critical to the Crown’s case fell away in cross-examination. The allegations dated back to New Year’s Eve 2016.
